Mel Gibson's former wife wants 400 percent more child support

Massachusetts custodial parents may find that the needs of children change with the pass of time and that court ordered child support is no longer sufficient. For this reason, the family court allows parents to file motions for child support modifications, as long as it is in the best interests of the children. An increased child support demand that was filed by a former wife of Mel Gibson will soon go to trial.

Gibson's former wife, Oksana Grigorieva, is reportedly no longer satisfied with the $20,000 per month settlement that was reached after they went their separate ways in 2010. She contends that the lifestyle to which she and their 6-year-old daughter were accustomed to must be maintained. This includes luxurious items -- such as travels, vacations, lodging and more -- and she now seeks no less than $100,000 per month.

After Grigorieva had accused Gibson of domestic violence prior to their separation, a settlement was reached that allows the mother and child to live in the family home. This will be until their daughter turns 18, at which time the property will be sold. A trust for the girl will be established with the proceeds. In addition to the child support, Grigorieva was also awarded a $750,000 settlement at that time.

While it is common for increased child support to be sought given a substantial change in circumstances, a non-custodial parent who is experiencing financial hardship may also seek to have child support lowered. When a motion for modified child support is filed, there are certain requirements related to substantiating the claims for either increasing or lowering the court ordered amount. It may become complicated and heated disputes are common. The guidance and support of an experienced Massachusetts family law attorney may be essential.
